Domestic violence and protection orders: where to start in NJ, NY and DC

General information for New Jersey, New York and Washington, DC · Last updated

Abuse can involve threats, stalking, sexual violence, coercion, financial control, or technology misuse; a person does not need visible bruises before seeking help. Whether conduct qualifies for a particular civil order depends on statutory acts, relationships, jurisdiction, and proof. Criminal reporting, civil protection, custody, housing, and immigration assistance are different pathways that may operate together.

NJ: The Prevention of Domestic Violence Act route depends on qualifying circumstances and relationships. A temporary restraining order and a final restraining order are different stages. After-hours domestic-violence applications may be made through local police. VASPA is a separate protective-order route for eligible sexual-offense, stalking, and cyber-harassment situations; NJ Courts says VASPA applications use the courthouse/JEDS process during court business hours, not police-station filing. Do not send someone needing after-hours VASPA relief to a nonexistent police filing process. Emergency danger still calls for police/emergency services. NY: Family-offense proceedings and criminal proceedings can both involve orders of protection. Current eligibility rules include statutory relationship requirements and recent expansions; get current screening rather than relying on an old exhaustive list of relatives. Family Court is not the sole possible route for every victim. NY Courts — Domestic Violence / Family Offense.

DC: Superior Court’s Domestic Violence Division handles Civil Protection Orders (CPOs), Anti-Stalking Orders (ASOs), and Extreme Risk Protection Orders (ERPOs), among other matters. These are different orders with different eligibility and purposes. Intake services can explain the applicable process. A civil protection application does not always require a prior police report. In every jurisdiction, read the exact order. Safety planning remains important even after an order is issued. Service, hearing dates, expiration, weapons provisions, contact restrictions, and child-related terms need individual attention. No order can guarantee safety.
