Can bankruptcy erase taxes, support or fines?

General information for New Jersey, New York and Washington, DC · Last updated

Quick answer

Some obligations are excepted from discharge; tax treatment and other exceptions require detailed review.

Do now

Gather tax returns and assessments, support orders, fines, dates, and prior payment records. Ask which debts may be dischargeable, which remain payable, and how they would be treated under each chapter.

Watch for

“All taxes are erased” and “no taxes can ever be erased” are both unreliable generalizations. Domestic support has special protection; a discharge does not cancel every government obligation.
