Quick answer
Ownership names alone may not settle the division. Classification, contributions, agreements, valuation, and local law matter.
Do now
Gather deeds, mortgage statements, account statements, purchase dates, inheritance or gift records, and any premarital agreement. List assets and debts separately. Ask what must be valued and how transfers would be completed.
Watch for
“Equitable” does not automatically mean equal. A property award may not remove a borrower from a mortgage or change a lender’s contract rights.
